ALFI responds to the ESA consultation paper on DORA draft regulatory technical standards on specifying the criteria for the classification of ICT related incidents

On 8 September 2023, ALFI responded to European Supervisory Authorities’ (ESAs) consultation paper on DORA draft regulatory technical standards on specifying the criteria for the classification of ICT related incidents, materiality thresholds for major incidents and significant cyber threats under Regulation (EU) 2022/2554.

 

On Monday 19 June, the ESAs launched a public consultation on the first batch of policy products under the Digital Operational Resilience Act (DORA). This includes four draft regulatory technical standards (RTS) and one set of draft implementing technical standards (ITS). Article 18(3) of DORA mandates the European Supervisory Authorities (ESAs) to develop common draft regulatory technical standards further specifying the:

  • The classification criteria for determining major ICT-related incidents;
  • The criteria to be applied by competent authorities to assess the relevance of major incident; and
  • The criteria to classify cyber threats as significant.
